LA CANNOT PITCH THE PERSONAL PROPERTY OF HOMELESS - COURT RULING - CAROL SOBEL ATTORNEY

"Upholding a court order against Los Angeles, a panel of the U.S. 9th Circuit Court of Appeals ruled, 2-1, that the personal possessions the homeless leave for a short time on city sidewalks may be taken only if the possessions pose an immediate threat to public safety or health or constitute criminal evidence
Even then, the court said, the city may not summarily destroy the property and must notify the owners where they can pick it up."


We know that some shopping cart homeless are hoarding, but we also know of people who have had their gym bag seized which contained their social security card, their passport, their birth certificate, their drivers license and so on, things they could not afford to replace or had no mailing address to receive if they had the money. We know that some of the shopping cart people are mentally ill, or have had it with shelters and "want" to be part of their street community. For the so called middle class that's loosing everything due to long term joblessness, the loss of homes and apartments, and so on, housing is a great priority.
