LOS ANGELES DROPS APPEAL IN HOMELESS PROPERTY SUIT

Eight Skid Row residents filed suit in 2011, accusing city workers, accompanied by police, of confiscating and dumping their personal possessions including medication, identification, cellphones and toiletries.

City officials said allowing homeless people to leave belongings on sidewalks creates a health hazard and violates municipal ordinances.

In a 2-1 decision, the 9th U.S. Circuit Court of Appeals ruled the confiscations violated homeless people's Fourth Amendment protection against unreasonable seizures. The belongings could be taken only if they posed an immediate public health threat or were evidence of a crime, the ruling said.

Homeless people around the Civic Center say police have stepped up enforcement in recent months and have been confiscating their personal belongings.
They have organized into a group and meet on Fridays to discuss issues and needs of the homeless, said the group’s spokesman, Tim Houchen.

A handful of homeless people who congregate at the Civic Center asked the City Council on Tuesday night to implement a moratorium on camping citations and asked that the Police Department stop confiscating their personal items. One man said police have been conducting “midnight raids” where the homeless congregate.
